Terms and Conditions of Service

1. Introduction

These Terms and Conditions ("Terms") govern all services provided by Solar Ark to its Clients. By engaging Solar Ark, the Client agrees to abide by these Terms. Solar Ark reserves the right to update these Terms as needed. Clients will be notified of material changes.

2. Definitions:

  • "Solar Ark" refers to the business entity providing design, installation, consulting, and related services.

  • "Client" refers to the individual, business, or entity engaging Solar Ark for services, including their representatives, agents, or guests present during the project.

  • "Installer" refers to the authorized representative of Solar Ark performing the work.

  • "Services" refers to the design, installation, consulting, and related work provided by Solar Ark.

  • "Service Agreement" refers to the written or electronic agreement between Solar Ark and the Client, including these Terms, quotes, invoices, and any additional addendums.

3. Scope of Services

Solar Ark prioritizes safety, compliance, and effectiveness in all installations. No electrical work will commence without a preliminary analysis to:

  • Assess compatibility and safety of components.

  • Determine the optimal installation approach.

  • Ensure compliance with manufacturer specifications.

4. Client Responsibilities

  • Provide accurate information about their system/vehicle.

  • Ensure a safe, accessible workspace.

  • Comply with local laws/regulations.

  • Provide suitable components (if applicable).

Note: Clients understand that inaccurate information or unsuitable components may delay the project or incur additional costs.

5. Safety and Conduct

Attention to detail is critical to ensure a safe, high-quality installation. By the nature of this work, installations will likely be performed while the client is nearby. For sake of safety and quality, all clients are asked to reserve all questions for before or after installation. Any clients in violation of this condition will, after warning, be charged an education fee for furthered knowledge of their system.

Solar Ark is not liable for accidents or injuries caused by client negligence.

Solar Ark reserves the right to immediately stop work, refuse service, or leave the job site if any person (including the client, bystanders, or visitors) engages in behavior that:

  • Poses a safety hazard to themselves, Solar Ark, or others.

  • is disrespectful, aggressive, or abusive toward Solar Ark, the land, or any person in the vicinity.

  • Creates a distracting or unsafe environment during installation or service (e.g., loud arguments, intoxication, or disregard for safety instructions).

If work is stopped due to such behavior, no refund will be issued for work completed up to that point. Solar Ark is not responsible for any delays, additional costs, or inconveniences resulting from the client’s or others’ conduct. Client agrees to reimburse Solar Ark for any additional costs incurred due to early termination (e.g., travel, lodging, or rescheduling fees).

All clients are to keep a distance of at least 5 feet from all electrical equipment being installed, unless specifically directed otherwise by the installer. Any work in progress which is made unsafe by the actions of the client will immediately be terminated until a safe working environment is reestablished, at the discretion of the installer. Clients which repeatedly violate this condition forfeit further development of the electrical installation. Any electrical work will be placed in a safe condition before it is paused or halted, if such a condition is not currently met.

6. Payment Terms

Payment Methods

Solar Ark accepts conventional payment options such as cash, check, or card. Card payments are accepted through Square or Stripe. Unconventional payment and bartering options for valuables such as gold, silver, and certain ammunitions may also be accepted. Gold and silver are valued at the current spot price, and ammunition and other valuables are valued at retail price, as applicable. All payment methods must be agreed upon before work begins.

Solar Ark does not accept payments through Venmo, Cash App, PayPal, or similar payment apps.

Deposit Requirements

  • A non-refundable deposit is required to book all projects.

  • Exact deposit amounts and payment schedules are detailed in the client’s project agreement(s).

Late Fees

  • Overdue balances incur a 1.5% monthly late fee until paid in full.

Refund and Cancelation Policy

  • Deposits are non-refundable once work has begun or materials have been purchased.

  • Cancellations within 24 hours of an appointment may not be authorized to receive a refund for the scheduling deposit.

Pricing and Estimates

  • Estimates are not fixed unless specified in writing.

  • Final pricing may vary due to unforeseen complexities or client changes.

7. Liability and Warranties

Limitation of Liability:

  • Solar Ark is not liable for indirect damages (e.g., lost profits, inconvenience).

Warranty Terms:

  • Solar Ark warrants its labor and workmanship for 1 year from completion. This warranty does not cover parts/components, which are subject to their manufacturer warranties. The warranty is void if the client modifies the system or causes damage through misuse or neglect.

  • Solar Ark’s 1-year workmanship warranty only applies if Solar Ark performs the installation. Third-party installations void this warranty.

Client Indemnification:

  • Clients agree to indemnify Solar Ark for damages caused by their actions or negligence.

8. Intellectual Property

  • All designs, plans, and documentation created by Solar Ark remain its property.

  • Clients may not reproduce or share proprietary materials without permission.

9. Confidentiality

  • Solar Ark will not share client information unless required by law.

  • Clients agree not to disclose Solar Ark’s proprietary methods or designs.

10. Termination and Cancellations

By Solar Ark:

  • Right to terminate for safety, non-payment, or breach of terms.

By Client:

  • May cancel, but deposits are non-refundable if work has begun or within 24 hours of an appointment.

Fees:

  • Early termination may incur travel/lodging costs.

11. Dispute Resolution

  • Attempt to resolve disputes via mediation before legal action.

  • Governing Law: "These Terms are governed by the laws of the State of Arizona, and any disputes shall be resolved exclusively in the courts of Arizona."

12. Force Majeure

  • Solar Ark is not liable for delays or failures caused by events beyond its control (e.g., natural disasters, supply shortages).

13. Miscellaneous

  • Entire Agreement: This document supersedes all prior agreements.

  • Severability: If any clause is unenforceable, the rest of the agreement remains valid.

  • Amendments: Changes must be in writing and signed by both parties.

Privacy Policy

We collect only what we need to provide our services:

  • Contact Info: Name, email, phone number (for estimates, contracts, and follow-ups).

  • Payment Info: If you pay with card via Square/Stripe, your payment details are processed by them (we never store card numbers).

  • Project Details: Information about your electrical system (e.g., solar setup, battery type) to fulfill your request.

We do NOT collect:

  • Cookies or tracking data (unless required by our website host).

  • Location data (beyond what you provide for service calls).

2. How We Use Your Info

Your data is used solely to:

  • Provide quotes and services (e.g., solar installations, repairs).

  • Communicate with you (e.g., scheduling, follow-ups).

  • Fulfill legal obligations (e.g., contracts, warranties).

We do not:

  • Sell or share your info with third parties (except as required by law).

  • Send marketing emails or newsletters (unless you opt in).

3. How We Protect Your Info

  • Encryption: Contact forms and emails are sent via secured channels (SSL/TLS).

  • Storage: Physical notes (e.g., paper contracts) are kept securely and destroyed after 1 year. Other files are stored electronically on a protected laptop. Your data is never uploaded to a cloud service.

  • Digital Data: Stored in password-protected files (e.g., encrypted emails, local devices).

4. Your Rights

  • Access/Delete: Ask us to show or delete your data anytime by emailing SolarArkElectrical@gmail.com.

  • Opt-Out: Reply STOP to any text/email to unsubscribe.

5. Data Retention

  • We keep your project documents and contact info indefinitely for warranty, follow-up, and service purposes.

  • If you ask us to delete your data, we’ll remove it from active systems but may retain paper records or backups for legal reasons.

  • Cash clients: We minimize records - your privacy matters.

6. Changes to This Policy

We’ll notify you of major changes via email or our website. Minor updates (e.g., typos) won’t require notice.
